摘要  专利的评估当中应当始终遵循经济、技术因素与法律因素相结合的考量原则，通过对传统经济学中弊端的分析得出了法律因素在专利评估中至关重要的作用，研究分析了专利的申请权因素、权利属性因素、专利法律特性因素、使用状态因素、权利要求书因素，通过法律因素考察制定了按照法律因素进行的评估方法，设想了法律因素参数结合经济学的收益法计算出法律角度下较为全面的专利价值。

Abstract: The combination of the economic, technical factors and legal factors should be
kept on in the evaluation of patent. Though the analysis of defects in the traditional
economics,we can conclude that the legal factors play an important role in the evaluation
of patent. This thesis analyze the factors of application rights of patent, property rights,
law state, the right certificate and the environment of law.  point out that the factors of
law should be combined with the "profit method "to get the thorough value of patent.
