摘要  针对当前我国开源软件知识产权问题认识混乱和概念不清的现状，分析归纳了开源软件知识产权问题主要表现出的五个方面，详细对比了开源软件、商业软件、公有软件三类软件的知识产权差别，并对有关开源软件知识产权的几个常见问题进行了解释和说明。

Abstract: Due to the state nowadays of  people can not recognize the intellectual 
property of open source software clearly in our country, five aspects of open source 
software intellectual property were analyzed, and intellectual property of open-source 
software and business Software and public Domain Software were compared detailedly
in the paper. Moreover, a few of frequent issues of open source software intellectual
property were discussed and explained.
