摘 要 丹麦政府2007 年向世界贸易组织（WTO）通报了在公共部门强制实施开放标准的政策。尽管开放标准在当时已经成为信息技术领域一个重要的政策议题，但时至今日，WTO 成员没有就丹麦开放标准政策进行任何讨论。WTO 成员“忽视”丹麦开放标准通报主要原因是：WTO《技术性贸易壁垒协定》（TBT）对通讯技术标准适用性不明确，围绕该通报的讨论难以产生有意义的结果。丹麦开放标准通报说明了《TBT 协定》在解决技术标准、特别是信息技术标准相关贸易纠纷中的局限性，以及加强信息技术标准适用性研究的重要性。

Abstract: In 2007, Denmark government notified the World Trade Organization (WTO) of 
its mandatory open standards policy in public sectors. Even at that time open standards 
had been an important policy issue, to date, there has been no discussion on this 
notification within the WTO. The main reason WTO Members “neglect” Denmark 
notification is that there will be hardly meaningful result from discussions on this 
notification since the application of WTO Agreement on Technical Barrier to Trade (TBT) 
to information standards is not well defined. Denmark notification on open standards
exemplifies further the limits of the TBT Agreement in settling standard, especially 
information standard related trade
disputes.
